1. Our Policy
Akari Studio ("Snowfield", "we") respects the intellectual property rights of others and expects users of the Snowfield learning workspace to do the same. We respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act ("DMCA", 17 U.S.C. §512). This page explains how to submit a takedown notice or a counter-notification, and how we handle them.
2. Designated Agent
Our designated copyright agent for notices under the DMCA is:
- Akari Studio — DMCA Agent
- Email: [email protected]
- Subject line: DMCA Notice (takedown) or DMCA Counter-Notification
Please send notices only to the designated agent. Notices sent elsewhere, including to our hosting or payment providers, may not be processed.
3. Takedown Notice Requirements
To be effective under 17 U.S.C. §512(c)(3), your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
- Identification of the material you claim is infringing, with information reasonably sufficient to let us locate it — for Snowfield, the URL of the page or content (for example a forum post, note, or uploaded file).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
4. What We Do With a Notice
When we receive a notice that meets the requirements above, we will review it, and if it is valid we will remove or disable access to the allegedly infringing material, and notify the user who posted it. We may also, at our discretion, disable the account of a repeat infringer (see section 6). We keep a record of notices we act on.
5. Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notification to the designated agent under 17 U.S.C. §512(g). It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. federal court for your judicial district (or, if outside the U.S., the district where Snowfield is located), and that you will accept service of process from the person who filed the original notice.
If we receive a valid counter-notification, we may restore the material in not less than 10 nor more than 14 business days, unless the original complainant files a court action.
6. Repeat Infringers
In accordance with 17 U.S.C. §512(i), we will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of others' copyrights.
7. Misrepresentation Warning
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
